The mandate of our By-law Enforcement division is to achieve compliance with municipal by-laws through education, mediation, and as necessary, enforcement and prosecution.     The Leamington By-law Enforcement Department and the Ontario Provincial Police (OPP) can both respond to incidents regarding unnecessary noise. The OPP non-emergency number is 1-888-310-1122. Alternatively, you can contact Leamington By-law Enforcement during regular business hours at (519)326-5761 or report the issue online 24/7 through the Municipality's website at www.leamington.ca/reportanissue.

    Thank you for your question. The Municipality of Leamington does not have a By-law that prohibits residents from putting laundry out to dry on a clothesline from the front of the house to the garage.

    The By-law Enforcement Department responds to complaints as well as conducts proactive patrols regarding parking violations. Many of the areas within the Municipality have different restriction regarding the allowable time a vehicle can be parked on a street. The best course of action is to contact the By-law Department to have the matter investigated.

    Thank you for your question. There is no specific time of day that permits a dog to bark more than the By-law allows. By-law 51-18 regulates noise and states in section 3 (a) no person shall permit the persistent barking of a dog of which the person is the owner or has care and control. "Persistent" means of a continuous duration of not less than ninety (90) seconds per occurrence and occurring more than three times within a period of thirty (30) minutes.

    With respect to your question about gazebos, we have included Section 4.1 from our Zoning By-law for your information. If a Gazebo does not fall within these guidelines, you must contact our Building Department to obtain the proper permits. 

    4.1 Accessory Uses, Buildings and Structures Accessory uses, buildings or structures are permitted in any yard, in any zone, subject to the provisions of this By-law for the particular zone in which said building or structure is in or use is located and provided that they: 

    a)    shall not be used for human habitation, except where a residential dwelling unit is a permitted accessory use; 

    b)    shall not be built closer to the front lot line or exterior side lot line than the minimum distance required by this By-law for the main building on the lot unless the lot abuts Lake Erie. Accessory buildings or structures shall not be built closer than 1 m (3.28 ft) from the front lot line for lots that abut Lake Erie; 

    c)    shall not be built closer than 1 m (3.28 ft) to any interior side lot line and 1 m (3.28 ft) to any rear lot line except: i) that common semi-detached private garages, decks or carports may be centred on a mutual side lot line; ii) that in the case where a side or rear lot line for a commercial or industrial use abuts a residential or holding residential zone, accessory uses, buildings or structure shall comply with the minimum required yard for the main building on the lot; 

    d)    shall not exceed 10 % coverage of the total lot area; 

    e)    shall not exceed 1 storey and the following maximum heights: 

    1. in all residential zones, 4.5 m (14.76 ft); 
    2. in all agricultural zones, 6 m (19.68 ft); 

    iii)   in all other zones, 10 m (32.80 ft); 

    f)     shall not be built within 2 m (6.56 ft) of the main building or from another accessory building, structure or use; 

    g)    shall not be considered as an accessory building or structure if attached to the main building in any way; 

    h)    shall not be permitted without a main building or structure; and 

    i)     where a required rear yard abuts a required front yard of an abutting property, the accessory building or structure shall not be located within a triangular space for a distance of 6 m (19.68 ft) measured along the exterior lot line and the interior lot line of the abutting lot (see illustration of “Yard” in the definitions).

    When building a fence on a property line, a concrete pad and the related heating pump for the pool must be located a minimum of 1.5m from the lot line (fence). It cannot encroach into the required side yard of 1.5m for an interior side yard.

    The Municipality has a by-law, being By-law 668-06, that provides for the regulation and registration of dogs within Leamington. It is an offence to permit a dog to run at large and fail to remove dog excrement. This specific by-law can be enforced by a municipal By-law Enforcement Officer or the Municipality’s Animal Control Officer.

    To report dogs running at large or owners not cleaning up after their dogs, please visit leamington.ca/reportanissue or contact the Animal Control Officer directly at 519-796-3013.

    Leamington Council passed By-law 08-18, a by-law regulating motor vehicle parking in residential zones and specifically making it an offence to park a motor vehicle other than in a garage or residential driveway.
